How do you ask someone to execute your estate?

On Behalf of | Oct 29, 2024 | Estate Planning

It can be challenging to ask someone, particularly someone you have a personal relationship with, to carry out the wishes in your will and other potentially complex duties. Thus, it’s vital to know how to handle this conversation.

Here is how you can ask someone to be your executor:

Have a list of the assets in your estate

Before holding the conversation, list the assets and liabilities in your estate, essentially, what your chosen party will manage and eventually distribute or pay. Chances are you already have such a list, as you may have created one when drafting your will. If you don’t, consider making one.

A detailed record of your assets, such as real estate, bank accounts and digital assets, and liabilities, like debts and taxes, can help your chosen party determine how complex your estate is and if they can administer it.

Further, if you have funeral wishes, write them down and allow your chosen party to read them during your initial conversation.

Tell them why you chose them

During the conversation, before handing your chosen party the above-mentioned documents, let them know why they are your choice. Inform them of the qualities they possess that you believe will help them serve competently as your executor.

Inform them about their duties

Your potential executor should understand every duty they are expected to perform if they accept the role. It can also be beneficial to inform them about the challenges they may face and how you can help them deal with such difficulties, such as connecting them with professionals.

Encourage them to ask questions to ensure they are adequately informed.

Ask them to take time

After the conversation, let your chosen party know they can take time before deciding.

Your chosen party can accept or refuse the executor role. If they accept it, get legal help to authorize their appointment.
